Developer carried out earthwork without approval

DAYS after a stop-work order was issued to a developer carrying out earthwork without approval in Taman Sakap, Kajang, the Kajang Municipal Council sealed off the site.
Councillor S. T. Chandra Mohan, during a media briefing, said although the housing project was given the green light, approval for earthwork near Jalan 2 was still pending.
“The developer chose to carry on with the earthwork although the council had issued a warning. They clearly demonstrated no regard for the law so the council’s engineering department acted accordingly.
No approval: The developer carrying out hill-clearing work in Taman Sakap, Kajang, has yet to obtain the go ahead from the Kajang Municipal Council for earthwork. “The matter came to light when Taman Sakap residents lodged complaints that the hill-cutting was too close to their houses. Upon further investigations, the council also realised that the safety of road users was under threat,” he said.
Taman Sakap resident A. Sureya said the water tank belonging to Sekolah Menengah Teknik Kajang at the hilltop was 50m away from the double-storey terrace houses.
“Imagine if the tank were to take a tumble due to the manner in which the hill-clearing work is being done. The developer does not have the council’s green light so who is going to take the blame if a tragedy occurs,” she said.
Chandra Mohan also produced a copy of the stop-work order addressed to the company’s headquarters in Taman Desa, Kuala Lumpur, dated Aug 11.
Under Section 70A (1) to (12) of the Street, Drainage and Building Act 1974 (Act 133), the developer was ordered to erect a signboard with details of the project at the main entrance to the site and to build hoarding around the perimeter.
A wash trough was to be built at the entry point, along with an earth drain and cut-off drains, leading to a silt trap. The trap and the water retention pond was also to be constructed and maintained regularly.
As a final measure, the developer was ordered to cover the exposed slope posing a danger to residents and road users with polyester sheets to prevent soil movement and soil erosion.
The developer has been given 14 days to comply with the directive, failing which MPKj will initiate legal action without further notice.
