Down with the rules, up goes residents’ tax

What? Assessment bills with a 10% increase are out.
Who? MPPJ and PJ residents.
When? From Jan 14.

THE assessment bills dated Jan 14 are out and most Petaling Jaya residents should have received the letters by now. They state that there is a 10% increase in the 2006 assessment tax.

The increase means that the pervious taxation of the valuation of land goes up by a maximum 10% for landed properties. Residents who were paying 5% to 8% of the value of their land will now have to pay 5.5% to 8.8% of that value.

In an immediate response some 35 residents associations in Petaling Jaya are meeting tonight to discuss, among other things, filing a lawsuit against the Petaling Jaya Municipal Council (MPPJ) if need be.

The Local Government Act 1976 (Section 127) states that the local authority “may, with the approval of the State Authority, from time to time as is deemed necessary, impose either separately or as a consoli- dated rate, the annual rate or rates.’’

However, under the principle of administrative law and good governance, MPPJ is duty bound to prove how they come up with the new rates and allow time for the people to object before any increase in rates can be approved.

“These are the main points, but there are many other issues that we would discuss during the meeting,” said Section 5 Residents Association chairman Edward Lee.

“Even if the residents associations and Rukun Tetangga committees are doing the work, residents should come forward in support if they believe in the cause,” said Taman Mayang Jaya and Taman Megah Residents Association chairman Liew Wei Beng.

Petaling Jaya residents should get in touch with their residential associations if they would like to participate in tonight’s forum.

The meeting will be held at La Salle Hall, Jalan 5/15B, off Jalan Chantek 5/13 in Petaling Jaya. It begins at 8.30pm.
