Petition filed wrongly

LABUAN: The Syariah Court here turned down a former Roman Catholic’s attempt to return to Christianity after his conversion to Islam because he had used the wrong process.

Yesterday, the court ruled that Kenneth Wong Chun Chiak should file a summons and statement of claim instead of the notice of application supported by the affidavit he had filed.

This was in accordance with Section 7 of the Akta Tatacara Mal Wilayah, Federal Territory Syariah Court chief judge Husin Ahamad said in his ruling.

Husin said the court was willing to hear Wong’s application if he filed it again.

Wong, 39, represented by counsel Ahmad Razali Isnin, named the Registrar of Converts in the Labuan Islamic Affairs Department as respondent in his application filed on May 9 this year.

In his application, Wong, who took on the name Kenny bin Abdullah when he converted to Islam on Jan 22, 2001, said he never practised Islam after his conversion. Instead, he had continued to be a practising Christian.

His affidavit did not say why he converted to Islam.

Wong said he had publicly announced that he was no longer a Muslim through a statutory declaration on March 1.

Wong also said in his application that he was seeking a declaration to have his name removed from the list of Muslim converts in the Labuan Islamic Affairs Department.

He also said the application was to enable him to marry a non-Muslim woman and to live as a non-Muslim.

At the hearing yesterday, the Registrar and the department were represented by counsel Zulkifli Che Yong and Azmi Datuk Dr Mohd Rais. Also present were Labuan Islamic Religious Affairs Council legal advisers Eidey El Nimeiry and Ridwan Abol.
