Doctor files appeal to reduce RM120,000 fine

KUALA LUMPUR: A doctor who was fined for failing to register his clinic under the Private Healthcare Facilities and Services Act has filed an appeal to the High Court yesterday to reduce the amount.

His lawyer Karpal Singh filed the motion at the High Court (Criminal) Registry. The notice was also accompanied by an affidavit affirmed by the doctor’s wife.

Dr Basmullah Yusoff, 45, the sole proprietor of Pusat Perubatan Al-Hilal Sdn Bhd, was fined RM120,000 in default three months’ jail last month after he admitted to the offence.

He was the first person in the country to have been convicted under the Act.

Dr Basmullah was found to have operated his clinic in Desa Petaling for 10 years without registering with the Health Ministry when health officers inspected the premises last July.

In the notice, Dr Basmullah appealed to the court to use its revisionary powers to reduce the fine imposed or bind him over on a good behaviour bond.

He also asked for other order deemed fit by the court.

In the affidavit, the doctor’s wife, Norliza Hassan, 44, said her husband was currently being held at the Kajang Prison after they were unable to settle the fine.

She said Dr Basmullah was not represented during the court proceedings and unaware of the maximum fine.

“My six school-going children and I are still shocked of the fine imposed,” she said.

Norliza said she has to work as a cook at a canteen now to support her family.
