Ganja in the PM’s Dept: Two told to enter defence

KUALA LUMPUR: Two men charged with trafficking 705.58g of cannabis in the Prime Minister’s Department four years ago have been called by the High Court to enter their defence.
High Court judge Justice Lim Yee Lan handed down her ruling Thursday at the end of the prosecution case which saw 11 witnesses testifying against both the accused.
She ruled that both Mohd Noor Adamiah Zakaria, 25, and Mohamed Iqbal Aminallah, 42, had joint physical custody and knowledge of the drugs, and that there was no break in the chain of evidence in the case against them.
“Based on these, I find that that the accused had joint possession of the drugs, and they are considered as having the intention of trafficking it as charged, unless proved otherwise.
“After examining the credibility of all 11 witnesses and considering the inference, the court finds that there is a prima facie case against them. This court calls the accused to enter their defence as charged,” she said.
The two were jointly charged with having in their possession 705.58g of cannabis, with the intention of trafficking it at the stairwell of the Economic Planning Unit (EPU) building at the Prime Minister’s Department at about 6.30pm on April 20, 2005.
This amounts to an offence under Section 39B(1)(a) of the Dangerous Drugs Act 1952, and if convicted, they will face the gallows.
Heading the prosecution is Deputy Public Prosecutor Mohamad Mustaffa P. Kunyalam, while Abdul Rashid Abdul Rahman and Datuk Hanif Hashim acted as counsel for Mohd Noor Adamiah and Mohamed Iqbal respectively.
The court fixed Oct 9 to hear their defence.
