Dad charged with killing daughter has case moved to High Court

GEORGE TOWN: The case of an odd-job worker charged with murdering his seven-year-old daughter whose skeletal remains were found in a shallow grave in a field has been transferred to a High Court for trial.

Deputy Public Prosecutor Tan Guat Cheng told a magistrate’s court Monday that the prosecution had obtained the requisition order for the case to be transferred to a High Court.

The 40-year-old man is alleged to have murdered the girl, whose birth was never registered, at their apartment in Medan Angsana 1, Bandar Baru Air Itam here, between 7am and 7pm on Nov 11, 2004.

The skeletal remains of the girl, who was believed to have been beaten to death, were exhumed from a shallow grave at a field near a hypermarket in Jalan Kampung Pisang, Air Itam on April 29.

Police had found bone fragments and a cracked skull buried in a metre-deep grave. The victim’s hands and legs were tied.

The man’s trial at the High Court will be held on a date yet to be fixed.

When he was charged on May 12, the accused was ordered to the hospital for a psychiatric evaluation after he did not respond to the charge against him.

However, when the case was mentioned again on Aug 10, he was found to be fit to stand trial after a report from Hospital Bahagia Ulu Kinta described him to be ‘cukup sihat’ (healthy).

The man also faces a charge of committing incest with a teenage daughter at the men’s toilet in Kompleks Farlim Air Itam, at 12.30pm on Feb 7.

The case will be mentioned on Oct 23.

Murder is punishable by death upon conviction while incest is punishable under Section 376B of the Penal Code with a jail term of between six and 20 years and whipping.
