Rocker Amy can be held liable: High Court

KUALA LUMPUR: Rock singer Amy of Search can be held liable for negligence in a case where a child was scalded by tomyam (spicy Thai) soup, the High Court ruled. Justice Lau Bee Lan, in making her decision in chambers, set aside the Sessions court’s order on Jan 30 to quash the negligence suit against the singer, and ordered it be remitted back to the Sessions Court for a full trial.

Counsel Adnan Seman for the plaintiff Nik Muhammad Zakwan Nik Zahir, three, said Amy was liable to be sued as newspaper reports stated he was the owner of Restoran Cheng Ho where the incident occured.

The plaintiff’s father Nik Zahir Nik Mohd Idris had filed a negligence suit on his behalf in the Civil Sessions Court on Sept 24 last year.

It claimed that an employee of Restoran Cheng Ho in Wangsa Maju had been negligent, causing Nik Muhammad Zakwan’s back to be scalded.

Amy’s counsel Ahmad Zaharil Muhaiyar argued that Amy, whose real name is Suhaimi Abdul Rahman, should not be sued as an individual, as the restaurant belonged to IconHill Sdn Bhd, of which Amy was a shareholder and board member.

The Sessions court fixed Nov 5 for mention.
