Ex-Army man gets 140yrs, 40 strokes for raping daughters (Updated)

KUALA LUMPUR: He was a decorated army corporal, but at home he was a monster who repeatedly raped and molested his two under-aged daughters.
For that, the Sessions Court here sentenced the 43-year-old corporal to a total of 140 years in jail, from the date of his arrest on June 25, last year, and to 40 strokes of the rotan, after he pleaded guilty to nine counts of raping and molesting his two daughters.
However, he will only serve 25 years’ imprisonment as his jail-term is set to run concurrently.
Judge Fathiyah Idris, in passing sentence, described his offence as despicable because as a father, he was suuposed to protect and guide his young daughters.
She said she was of the opinion that if the girls had not informed their counselling teacher of his actions, he would have continued raping and molesting them from time to time.
The court also ordered him to undergo counselling throughout his sentence, and to undergo a two-year observation period after he completes his jail term.
The father of five had earlier pleaded guilty to three counts of raping and two counts of molesting his older daughter, now aged 16, at their home in Sentul between Jan, 2006, and June, last year.
He had also pleaded guilty to four counts of molesting his second daughter, now aged 15, at their home between 2006 and May, 2008.
According to the statement of facts, all the incidences happened without the knowledge of the girls’ mother, who works as an assistant in a private clinic.
The statement also said that the older girl had been repeatedly raped but could not remember all the incidences.
Among the incidences she could remember was in May, 2007, when the accused raped her while she was sleeping in her room, and in May, 2008, when he asked her to help him shave his back in the bathroom, where he raped her again.
As for the younger daughter, the statement said he had repeatedly molested her by grabbing her breasts and rubbing his private parts against hers.
On June 24, last year, at about 10.30am, the older girl had confided in her counselling teacher, who then brought her and her sister to file a police report at the police headquarters here.
A medical check-up found that she had an old hymen tear, while her sister’s hymen was still intact.
Their father was arrested the next day at about 3pm at their home.
During mitigation, counsel for the accused P. Gunalan, said his client had received a certificate (Sijil Perkhidmatan Cemerlang), and other medals for his outstanding service in his 21 years in the army, and had served the Malaysian people.
Deputy public prosecutor Noor Aishah K.M. Abu Bakar, however, asked the court to mete out the maximum sentence against the accused as his crime was a severe one.
