Prosecution unable to read charge because of busy lawyer
KUANTAN: The prosecution was unable to read the charge against a lorry driver accused of trafficking in 753,359gm of syabu as his lawyer was not present in court.
Deputy Public Prosecutor Kalmizah Salleh was supposed to submit documents required before the charge against Lee Yong Toe, 48, could be read in the High Court.
But the court was informed that Lee’s counsel, J. Kuldeep Kumar, was engaged in another case in Kuala Lumpur.
Kalmizah said Kuldeep had called her requesting for the charge not to be read to his client yet and for a date to be fixed for a re-mention.
Judicial Commissioner Mariana Yahya fixed Nov 9 for the re-mention.
Lee was first charged on May 15 with drug trafficking at about 6.45am at KM3, Jalan Cenderawasih, Rompin on May 2.
Lee, of Taman Iskandar, Johor Baru, had pleaded not guilty to the charge allegedly committed with another person who is still at large.
He is charged under Section 39B(1)(a) of the Dangerous Drug Act 1952 (amendment) 1998 which carries the death penalty upon conviction.
