No discrimination against foreign workers
I agree with Human Resources Minister Datuk Dr S. Subrama-niam who, in reply to the Bagan Serai MP, said foreign workers need not have their own association to protect themselves.
In many ways, the Government has been fair to these workers as they are given equal rights under the law. They are allowed to join trade unions in their industry, as can be seen, for example, among the workers in the plantation and construction sectors.
These unions are supposed to attend to the welfare of workers, irrespective of their nationality. Union collective agreements with employers governing terms and conditions of service are equally applicable to foreign and local workers.
Therefore, according to the law, there can be no discrimination in wages and other benefits.
Moreover, the Employment Act which covers service benefits and protection also applies to workers irrespective of nationality.
In order to see the enforcement in practice, all we need to do is to visit a Labour Department office to see the number of foreigners who lodge complaints and make claims under such employment laws and collective agreements.
