Khalwat case: Norman and Memey not in same building
KUALA LUMPUR: The Gombak Timur Syariah Lower Court heard that the ‘khalwat’ (close proximity) charge against actor Norman Hakim and young actress Memey last year was wrong and not based on facts.
The prosecution’s first witness for the case, Abdul Rahman Lai Abdullah, an enforcement officer of the Selangor Islamic Religious Department (JAIS), said the charge was incorrect as Norman was not found at 3am in the premises as stated in the charge sheet.
He said Norman was found and arrested on the upper floor of the premises, while Memey was on the lower floor of another premises with a different address.
“I didn’t see any man while entering the premises (stated in the charge sheet) and I didn’t see any man while searching the ground floor and the ceiling of the upper floor,” he said during cross-examination by lawyer Fakhrul Azman Abu Hassan.
“You did not find the accused (Norman) at 3am in the premises. So, based in your fact and statement, I say that the charge is wrong,” said Fakhrul Azman while showing the charge sheet to Abdul Rahman.
Abdul Rahman also agreed with the lawyer’s suggestion that the inspection conducted by the religious enforcement officers that night was based on hearsay from a complain made through a phone call.
Fakhrul Azman: “How do you know that both the accused (Norman and Memey) were in the premises?”
Abdul Rahman: “From the information received from a complainant.”
Fakhrul Azman: “Would you agree that the inspection on the premises was based only on hearsay from the complainant?”
Abdul Rahman: “Correct.”
On Jan 20, 2008, Norman, whose real name is Mohamed Norhakim Zaidon, 33, pleaded not guilty to having committed ‘khalwat’ with Memey or her real name Suhaiza Suhaimi, 21, at 3am in an office at 41A, Jalan UP 1/2 Taman Ukay Perdana, Hulu Klang, on Oct 30, 2008.
If convicted, they can each be jailed up two years or fined RM3,000. The trial continues on July 31. - Bernama
