Federal Court: Anwar's dismissal is lawful

PUTRAJAYA: The sacking of Datuk Seri Anwar Ibrahim as deputy prime minister and finance minister 11 years ago was lawful, the Federal Court here ruled Monday.

Court of Appeal President Alauddin Mohd Sheriff and Federal Court judges Mohd Ghazali Mohd Yusof and Abdull Hamid Embong unanimously dismissed Anwar's final appeal for a declaration that his dismissal from his cabinet posts in Sept 2, 1998, was unconstitutional.

Alauddin held that the then prime minister, Tun Dr Mahathir Mohamad, had the authority under the Federal Constitution to sack his cabinet minister.

He said, the king, as a constitutional monarch, was required to act in accordance with the advice of the prime minister.

Anwar had lost his bids in both the High Court and Court of Appeal which ruled that Dr Mahathir had the authority under the Federal Constitution to sack his cabinet minister and had adhered to the constitution by advising the king on Anwar's dismissal.

The Parti Keadilan Rakyat (PKR) advisor wanted the court to declare that his dismissal by Dr Mahathir was unlawful and contravened the constitution as well as damages, to be assessed by the registrar, in lieu of reinstatement. -- Bernama
