Gallows for killing burglar


SHAH ALAM: Two Indonesian brothers were sent to the gallows by the High Court here after they were found guilty of murdering a burglar two years ago.

Frans Hiu, 22, and Dharry Frully Hiu, 20, were jointly charged with ha­­­­­ving a common intention in the murder of 26-year-old R. Khartic at a shophouse in 3A Jalan 4, Taman Sri Sungai Pelek in Sepang at 11am on Dec 3, 2010.

According to testimony presented during the trial, a witness saw Khartic breaking into the shophouse from the back entrance after he failed to break open the front door.

Khartic then entered the unit through the ceiling and fell into a room where the brothers and a Malaysian co-worker were sleeping.

The burglar then attacked the men and the Malaysian co-worker fled the scene during the struggle to contact the police.

Frans eventually managed to overpower Khartic by gripping him in an arm-lock from behind until he stopped moving. After realising that Khartic had become still, the brothers ran out of the unit.

The medical report confirmed that Khartic died due to blunt force trauma.

In her brief judgment, Justice Nurchaya Arshad ruled that the prosecution had successfully proven the case beyond reasonable doubt and sentenced the men to death.

A total of 15 prosecution witnesses took the stand.

The brothers were the only ones who testified in their own defence.
