Company director, wife charged with giving false statements to CCM

KUALA LUMPUR: A company director was charged with abetting with his wife to give false statements to the Companies Commision of Malaysia (CCM) over allotment of shares of their company and the appointment of a director.
Anuwa Mohammad Daud, 61, claimed trial Friday to abetting Nik Maisarah Nik Omar, 44, to giving a false statement in a form dated Dec 12, 2005 to the CCM over the allotment of 499,998 shares of Neutral Vest (M) Sdn Bhd.
His wife Nik Maisarah was also charged seperately with giving a false statement in relation to the allotment of shares.
Both were also each hit with another charge of giving false statements in a form dated March 6, 2007 over the appointment of Anuwa as the company director of Neutral Vest.
The alledged offences occured at the CCM offices at Putra Place, 100 Jalan Putra on March 6, 2007.
If convicted, they face a maximum 10 years' prison or a fine of up to RM250,000 for each of the charges under Section 364(2) of the Companies Act 1965.
CCM prosecuting officer Steve Chin Yun Cheong told the court that the offenses were non-bailable, but if the court chose to offer bail, he urged it be set at RM50,000 for each charge.
"Considering the stocks alloted were worth about RM500,000 in total, we feel this is an appropiate amount," he said.
Anuwa was represented by Nathisha Zainul Rashid, while Nik Maisarah's counsel was M. Reza Hassan.
He also asked that the two be tried together.
Judge Hasbi Hasan set the bail at RM20,000 with one surety for each charge for Anuwa, and RM15,000 with one surety for each charge for Nik Maisarah.
She also ordered them to surrender their passports.
The judge allowed a joint trial and fixed for Nov 5 for next case management.
