RM25,000 for woman who broke arm
KUALA LUMPUR: An executive who suffered a fractured arm after a fall in a restaurant was awarded RM25,000 in damages.
Zalina Ali, 44, had sued Grand Synergy Sdn Bhd and Dommal Management Sdn Bhd saying the two defendants had failed to ensure her safety when she visited a Domino’s Pizza cafe here.
Zalina said she had slipped and fallen when she and her friends had gone to the restaurant on March 27.
She suffered serious fractures on her right arm and was warded in a hospital.
Sessions Court judge Unaizah Mohd recorded the settlement between the parties in chambers yesterday.
Speaking to the media, Zalina said she filed her suit to create public awareness that restaurant operators have to ensure public safety.
Her lawyer Adnan Senan said that RM25,000 in damages was inclusive of costs to be paid to his client and that the consent settlement was reached without any admission of liability on the part of the defendants.
In her RM1.5 mil negligence suit, Zalina said the floor of the restaurant was uneven and there was no proper signage to alert customers.
She had sought RM500,000 each in general, exemplary and aggravated damages.
In its statement of defence filed on July 27, the defendants said the fall was a result of negligence on Zalina’s part.
