Bi-Anne's father gets full custody
By MAIZATUL NAZLINA
KUALA LUMPUR: The High Court here has granted full guardianship, custody care and control of 13-year-old Low Bi-Anne to her father Low Swee Siong, ending a four-year legal battle over her custody.
High Court judge Justice Yeoh Wee Siam made the ruling in chambers Tuesday after interviewing Bi-Anne for an hour from 8.15am.
Justice Yeoh also allowed Bi-Anne's mother, Tan Siew Siew, 38, access to her but subject to the girl's wishes.
Bi-Anne was accompanied by Low, 41, family members and counsel Pushpa Ratnam.
"I am very happy and will celebrate Valentine's Day dinner with my father," said the Form One student, who is studying in a school in Subang Jaya, when interviewed by reporters outside the courtroom.
Meanwhile, Pushpa said the access, among others, allowed Tan to celebrate Chinese New Year with Bi-Anne once every two years, while the girl was allowed to go to England, accompanied by her family members if she so wished.
On April 22 last year, the Court of Appeal had granted Low, a real estate negotiator, full-time interim access to Bi-Anne and a stay order on a 2008 High Court ruling which granted custody of the girl to her mother, who lives in London.
Low and Tan were married in 1999. The couple divorced in 2006, and custody of Bi-Anne was given to the father.
Two years later, Tan applied for and won custody and Low was given reasonable access.
However, Bi-Anne refused to go with her mother and insisted that she wanted to live with her father.
Low filed six appeals in September 2010 over the decision of a Family Court in Kuala Lumpur.
