PKFZ case: Dr Ling applies for judge to recuse himself

KUALA LUMPUR: Former Transport Minister Tun Dr Ling Liong Sik is applying for his trial judge to recuse himself from hearing his cheating case.

High Court judge Justice Ahmadi Asnawi had on March 9 ordered Dr Ling, 69, to enter his defence on three counts of cheating the Malaysian Government in relation to the controversial Port Klang Free Zone (PKFZ) project.

The judge set Thursday to hear the recusal application by Dr Ling.

Lead prosecutor Tun Abd Majid Tun Hamzah said Dr Ling was applying for the recusal on grounds that the wording used by the trial judge at the end of the prosecution's case was "strong".

Dr Ling's lead counsel Wong Kian Kheong told the trial judge that he had served a copy of the recusal application to the prosecution, who had replied with an affidavit.

Wong said he received the affidavit in reply on Friday and needed to get further instructions from his client.

In his application, Dr Ling said the trial judge had made comments in his findings which demonstrated there was a real danger of bias on the part of the judge.
