Ling's bid for trial judge in PKFZ case to be recused dismissed

KUALA LUMPUR: Tun Dr Ling Liong Sik's application for the trial judge in his cheating case to recuse himself has been struck out.

Judge Justice Ahmadi Asnawi dismissed the recusal application Thursday, saying it had no merit.

Earlier, Dr Ling had applied for the trial judge to recuse himself from further hearing and determing the case on grounds of apparent bias.

His lead counsel Wong Kian Kheong submitted that the test to be adopted where suggestion of apparent bias arises, is whether a reasonable, fair-minded and well-informed observer, having considered the facts, might reasonably apprehend that the judge was biased.

Deputy public prosecutor Manoj Kurup submitted that there was no real danger of bias as the judge had given his findings at the end of the prosecution's case based on maximum evaluation of evidence adduced in the trial.

Dr Ling had on March 9 been ordered to enter his defence over three charges of cheating the Government in relation to the Port Klang Free Zone (PKFZ) project.
