Ex-Chin Woo head to pay up

KUALA LUMPUR: A former Selangor Chin Woo Athletic Association president has been ordered by the High Court to pay another ex-president RM500,000 for defaming him.
Datuk Dr Low Bin Tick was ordered to pay Datuk Chong Tho Chin RM500,000 in damages after losing a consolidated defamation suit yesterday.
High Court judge Rozilah Yop ruled that the plaintiff, Chong, had succeeded in proving his case in all three actions making up the suit on the balance of probabilities.
Dr Low was ordered to pay Chong a combined amount of general damages of RM300,000, aggravated damages of RM150,000 and exemplary damages of RM50,000.
Judge Rozilah also ordered interest at 8% from the date of the suit until full settlement.
In his statement of claim, Chong, who was Chin Woo president from 1991 to 2001, claimed that Dr Low, president from 2001 to 2005, had made unfounded and defamatory complaints regarding him in letters to the Federal Territory of Kuala Lumpur Commercial Crime Investigation Department, the former Anti-Corruption Agency and the Registrar of Societies in 2005.
Dr Low had written about Chong’s involvement in a joint venture between Chin Woo and developer Jiwa Realty Sdn Bhd.
Chong, who is a lawyer, said they were defamatory as they implied he was, among other things, dishonest, unethical and disliked by other Chin Woo members.
He filed several defamation suits against Dr Low, a medical practitioner, in 2007, which were later consolidated.
Chong had also filed similar suits against 27 Chin Woo committee members on the same matter.
Rozilah dismissed these application with costs, ruling that Chong had failed to prove his case against them.
The plaintiff was represented by Chan Tse Yuen.
Dr Low was represented by Robert Low and Helen Lim, while the Chin Woo committee members were represented by Ken St James and Wang Siew Yong.
