Cleared drug conviction best Raya gift for couple

IPOH: It was the best Hari Raya gift for a couple when the High Court here overturned their previous conviction for drug possession.
Mohamad Azli Ismail, 29, and his wife Mona Zaitun Sabri, 31, who had been sentenced to jail, cried and hugged each other when the decision was announced.
“This is the best Hari Raya Aidilfitri gift for us. I am so happy that we will be able to spend the festive period with our three children,” said Mona.
The couple has three children, aged between nine and 10 months old. Their youngest, a girl, was born in prison as Mona was two months pregnant when arrested.
The couple, who were running their own business, had earlier been charged under Section 6 of the Dangerous Drugs Act for having 276.19g of cannabis at a house in Tapah on Feb 17, 2011.
They were convicted by the Sessions Court on Oct 21, 2011.
In his ruling, Justice Zainal Adzam Abd Ghani said the prosecution had failed to prove their case because other people could also access the room where the drugs were found as it was not locked.
“Analysis of fingernail clippings found in the room showed traces of drugs but the clippings belonged to someone else,” he said.
