PKR's Rafizi bids to quash Bafia charges

SHAH ALAM: PKR director of strategy Rafizi Ramli filed a motion in the High Court here Monday to quash the Banking and Financial Institutions Act 1989 (Bafia) charges against him.

Counsel N. Surendran told reporters that they had filed the application on the grounds that the proceedings were "an abuse of the prosecution's power".

"It is against public policy to punish someone for revealing an issue of public interest. How can you punish someone for exposing wrong doing?" Surendran said.

The three main grounds of the application were that the charge was an abuse of prosecution's power, that it was selective prosecution, and that it would be against public policy to charge Rafizi for exposing the alleged abuse of public funds.

He faces a maximum three years jail and maximum RM3mil fine, or both, if convicted.

Sessions Court Judge Aslam Zainuddin fixed next mention on Oct 10.

On Aug 1 this year, Rafizi had pleaded not guilty at a Sessions Court here to revealing confidential banking details linked to the National Feedlot Corporation (NFC) scandal.

The 35-year-old claimed trial to revealing details protected under the Bafia provisions on secrecy.

He was accused of having access to four customer profile documents relating to the balance summary of the National Feedlot Corporation Sdn Bhd, the National Meat and Livestock Sdn Bhd, the Agroscience Industries Sdn Bhd and corporation executive chairman Datuk Seri Dr Mohamad Salleh Ismail.

Rafizi had allegedly exposed the documents to media consultant Yusuf Abdul Alim and journalist Erle Martin Carvalho at the PKR headquarters in Merchant Square, Jalan Tropicana Selatan 1 on March 7, an offence under Section 97(1) of the Act.
