Engineer sues former lover

KUALA LUMPUR: An engineer has sued her former lover for failing to repay his personal debts to her, including bills for hotel rooms where they had slept together between 2005 and 2010.

Nur Shairah Ishak, 28, is also seeking damages for defamation and loss of dignity over slanderous statements made by her former lover in his Facebook postings and comments by his FB friends.

Her former lover Leftenan Efftizal Hazrie Roslan, however, said he was not aware that Nur Shairah would seek payment for all their expenses together, stressing that he would not have fallen in love with a calculative person.

In the hearing of her suit at the Sessions Court here yesterday, Nur Shairah, who is an Australian permanent resident, said she was seeking RM103,955 from navy officer Lt Efftizal Hazrie Roslan, 28, for failing to settle her claims.

Questioned by Lt Efftizal’s lawyer Fairuz Jaffril if she had told her former lover that she would be claiming for hotel bills each time they booked into hotel rooms, Nur Shairah said she was claiming for everything, not just for bills to hotel rooms.

She said her former lover had failed to respond to her e-mails and text messages, causing her to take legal action.

“He acknowledged that he owed me, but he did not do anything,” she said, adding that she always believed that Lt Efftizal would keep his promises to pay her back as he knew that the money she spent was never meant to be a present.

“Besides, the defendant and I had always considered that there was a valid agreement between us,” she said, adding that she had recorded all the expenses incurred when they were together in her diary which was acknowledged by him.

She also disagreed to Fairuz’s suggestion that she filed the lawsuit as an afterthought as she was angry at her former lover.

She, however, admitted that she was always delighted to spend time with Lt Efftizal whenever he came to Canberra to see her while they were studying in Australia.

She also admitted that they always went to places together as lovers.

Lt Efftizal testified that their relationship ended in mid-2010 after Nur Shairah alleged that he was seeing other women.

“I was uncomfortable as she was always asking me to come to Australia to meet her when I did not have enough money for flight tickets. She did not trust me,” he said.

In her lawsuit filed on Dec 19 last year, Nur Shairah said she and Lt Effitzal had often gone for holidays where most of the expenses, including flight tickets, bus and concert tickets, and lodging were paid by her on the understanding that he would pay half.

Sessions Court judge Jumirah Marjuki ordered the parties to file written submissions by Jan 25 and fixed Feb 4 to deliver her decision.
