Three get jail and whipping

SIBU: Three Indonesian men were found guilty of gang robbery in a house at KM37, Ulu Oya Road on May 25 last year.

In the 4.50am incident, a couple was robbed of RM1,000 and two handphones at knife point.

The three were charged under Section 395 and 397 of the Penal Code read with Section 34 of the same code which provide for a maximum sentence of 20 years imprisonment and to be whipped 24 times.

Sessions Court judge Indra Ayub yesterday afternoon sentenced second accused Baharud-din Usin, third accused Bohri Basok and fourth accused Roswadi Mohammad Nor to nine years’ jail and whipping three times each.

The first accused, Sayang Juing, who is a local was, however, acquitted and discharged.

In acquitting Sayang, the judge said the prosecution could not find any proof to convict him.

While sentencing the other three, the judge said the prosecution had proved the guilt beyond any reasonable doubt.

He added that he was satisfied that the evidence and chemist’s report were credible and the prosecution witnesses told the truth.

All the three pleaded for leniency saying that they had elderly parents and young children to take care of in Indonesia.

Deputy public prosecutor Azrul Faidz said the offence was serious and in the interest of the public, he urged the judge to pass appropriate sentences so that the law would be upheld.
