Jail and whipping stays for ex-army man


KUALA LUMPUR: A High Court has upheld the jail sentence and whipping against a former army personnel who was charged with raping a clerk two years ago.

High Court judge Justice Amelia Tee Hong Geok Abdullah dismissed Che Mohd Sufian @ Che Bastian Che Rashid’s appeal on the grounds that there was no mitigating factor.

Justice Amelia said losing his job and being a first-time offender did not carry much weight.

She said she was tempted to enhance the sentence to send a strong message to would-be offenders.

“I find the judge did not err in finding the appellant guilty. The 20 years’ imprisonment and seven strokes of the rotan is befitting.”

On Dec 13, 2011, Sessions Court Judge Emelia Kaswati Mohamad Khalid sentenced Che Mohd Sufian after he was found guilty of raping the 30-year-old clerk at his house between 7.20am and 8.30am on Nov 20, 2009.
