Facebook rapist pays price

SIBU: A 30-year-old lorry driver from a village in Teku was sentenced to five years’ jail and a stroke of the rotan for two counts of statutory rape of a girl whom he befriended on Facebook.
Sessions Court judge Indra Ayub, who ordered that the sentence run concurrently, said he passed the verdict after taking into consideration the accused’s plea of guilt, his mitigation, the facts of the case, public interest, the victim’s impact statement, and the prosecutor’s call for a deterrent sentence.
He said though the victim, who was then only 13 years old, had consented to the sex, the accused had committed an offence under Section 376 (1) of the Penal Code as the girl was underaged.
The wife of the convicted man wept outside the courtroom after the sentencing.
The victim in her statement said though she consented to the act, she was nevertheless angry, upset and regretful as her lover had cheated her by saying that he was single.
She also said that she had committed the act as she had developed strong feelings for the accused.
However, she did not care for his well-being anymore and whether his sentence was light or heavy.
The victim has been under the care of her step-parents since she was younger.
In mitigation, the rapist, who used to earn RM800 a month, said he needed to take care of his wife, and that his leg was not normal.
According to the facts of the case, the accused met the girl on Facebook. From online friends, they became lovers.
They had sexual intercourse five times, first at 11pm on in May, 2012, and subsequently in the man’s house from June to July, 2012.
The matter only came to light when the girl’s school reported to the step-parents that she was missing school as well as from the girls' dormitory where she stayed.
After the victim confessed to the act, the step-parents lodged a police report on July 3, 2012.
