Padang Serai MP Gobalakrishnan fined RM6,000 for taking part in illegal Bersih 1.0

KUALA LUMPUR: Padang Serai MP M. Gobalakrishnan and a bank officer Muhd Harith Fathillah Shahabudin were fined RM6,000 each for participating in an illegal Bersih 1.0 assembly and disobeying public order to disperse more than five years ago.
Sessions Court judge Jagjit Singh Bant Singh also ordered Gobalakrishnan, 53, and Muhd Harith, 30, be jailed two months' each if they failed to pay the fine.
Judge Jagjit found both guilty to the two charges after the defence failed to prove reasonable doubt in the case against the two.
“In his evidence, Gobalakrishnan had made a bare denial and that he did not remember what happened on that day although the video showed his involvement.
“Muhd Harith was at the scene for a long time up until he was arrested,” he said.
Meanwhile, Pas deputy president Mohamad Sabu, PKR vice president Tian Chua Chang and 11 others were discharged and acquitted after both had succeeded in raising reasonable doubt in their cases.
Saleh Mohamad Tahir was discharged not amounting to an acquittal earlier after his appeal was accepted by the prosecution and the charge against him was withdrawn.
Others included Mohad Zad Abdullah, Mohd Salim Yeslam, Ahmad RazaliAbd Rahman, Razali Abdul, Azahar Yusop, Sulaiman Ahmad, Taib Abdullah,Mohd Abi Salam Ariffin and Ishak Othman.
The group were jointly accused of participating in the illegal assembly, under Section 27 (5)(a) of the Police Act 1967, which carries a RM10,000 fine and jail of not more than one year upon conviction.
They committed the offences at several locations in the city, likeJalan Raja Laut, Jalan Istana Baru and Jalan Tun Perak here between1pm and 4pm on Nov 10, 2007.
They also faced second alternative charges of disobeying a public order to disperse and were charged under Section 275(4) of the same act.
Earlier, in mitigation, Gobalakrishnan's counsel S. Vijayaretnam said that Gobalakrishnan had three children and that one child was still schooling.
He added that Gobalakrishnan had also contributed his time to party members in his constituency.
