MACC expected to make court apology to Khalid
KUALA LUMPUR: The Malaysian Anti-Corruption Commission (MACC) is expected to issue an apology to Selangor Mentri Besar Tan Sri Khalid Ibrahim in open court tomorrow.
This follows settlement by both parties in a defamation suit filed by Khalid against the MACC and two others over allegations of abuse of power.
The matter was brought before Justice Lau Bee Lan in her chambers yesterday.
Khalid told reporters outside the High Court here that the MACC, through its former chief commissioner Datuk Seri Ahmad Said Hamdan, would make the apology.
However, the terms and conditions of the apology was not specified. Ahmad Said was absent from yesterday’s proceedings.
Senior federal counsel Noorin Badaruddin represented the defendants while lawyer S.N. Nair represented Khalid.
On April 27, 2009, Khalid sued Ahmad Said, the MACC and the Government for defamation over the statement that he had abused his power as the mentri besar.
In his suit, Khalid claimed that Ahmad had committed libel – in his capacity as the chief commissioner then – by disclosing in a press conference on Feb 20, 2009, that the MACC had evidence to show that Khalid abused his powers over the maintenance of his personal car and over the purchase of 46 cows for a Hari Raya Aidiladha event for the Bandar Tun Razak parliamentary constituency.
In his court papers, Khalid who sought for various damages, claimed that the statement meant that he was a liar, unprincipled, corrupt, unethical and an unfit politician who had committed a criminal offence.
Khalid applied for an injunction to stop the defendants from further uttering similar statements which he claimed had instigated public hatred against him and lowered his esteem in the eyes of the public.
He also said the MACC had acted beyond its powers and by its actions, had effectively usurped the exclusive powers and functions of the Attorney-General.
In his defence, Ahmad contended that he had never made any defamatory statement against Khalid in a bid to ruin his reputation.
