Seniman and seven others apply to strike out suit
KUALA LUMPUR: The National Association of Artistes (Seniman) and seven others have filed an application in the High Court here to strike out the suit filed by eight individuals, including seven veteran artistes, against the association.
The application was filed on Thursday at the High Court registry on grounds that the quorum to nullify the association’s annual general meeting was insufficient under the Seniman constitution.
Yesterday, the case was brought before Judicial Commissioner Rosilah Yop.
Wan Rahimi Wan Daud, who acted for the plaintiffs, told reporters that the case had been fixed for case management on March 8.
The plaintiffs Abu Bakar Omar, Sahlan Sudiran, Mior Ahmat Zaudi Mior Ali, Abdullah Sani, Merriane Mohd Tap, Jamaliah Mohd Dahan, Azizah Ab Aziz and Roslinda Buang had filed the suit on Jan 25.
Besides Seniman, also named as defendants in the suit are the association officials then, namely president Haron Aminar Rashid Salim or Harun Salim Bachik, secretary Omar Kamarudin or Yusof Kelana, treasurer Wafa A. Kadir and Zed Zaidi, whose real name is Rozaidi Abdul Jamil, who was then the acting deputy president.
In the statement of claim, the plaintiffs stated that Seniman’s 14th AGM as well as its 2011 financial report and the minutes of the meeting which were tabled on May 26 last year were null and void.
They are also seeking a declaration that the selection of office-bearers held during the meeting was also invalid.
Besides general and exemplary damages, as well as other relief deemed fit by the court, the plaintiffs are seeking an order for Harun, Yusof and Wafa to pay RM56,000 to the association.
