15 families in Bukit Antarabangsa landslide settle with developer, Syabas

KUALA LUMPUR: Fifteen families involved in the Bukit Antarabangsa landslide tragedy in 2008 have settled their negligence suits with developer Superview Development Sdn Bhd and Syabas.

High Court Judicial Commissioner Lee Heng Cheong was informed of the development of the civil dispute by their lawyers.

Speaking to reporters here, Syabas lawyer Steven Thiru said they have informed JC Lee that the parties have settled the suits without any admission of liability.

"It is subject to terms and conditions to be agreed upon," he said.

He said the parties would met JC Lee on May 21 to report on the progress of the settlement.

The families' lawyer Sunther Tulasi said he would withdraw the suits after the settlement was signed by the parties.

"We want to put it in writing," he added.

Engineer K.Thanarajah, 45, sued both defendants for the death of his wife, veterinarian Dr N.Yogeswary in the landslide.

His two sons T.Thivesh Raj, T.Avinesh Raj and his daughter, T.Priyankka, and his company C&S Engineering Management Sdn Bhd, who are also co-plaintiffs, filed the claim against the developer and Syabas.

In another claim, survivor Ng Tiong Tat has sued both defendants for the death of his accountant wife.

The plaintiffs, who are professionals and retirees, sought for loss of property, personal belongings, household items and vehicles.

Besides that, they applied for funeral expenses and compensation for alternate accomodation from Dec 6, 2008, the date of the landslide.

They filed the suits from 2010 to this year claiming that their losses were solely due to the breach of duty of care and negligence on the part of the developer and Syabas.

They claimed that the developer had started filling the slope on the land with earth and commenced the construction of link houses in 1984. They said that previous slope failures had occurred in 1984 and in November 1985 prior to the 2008 landslide.

They said Syabas owed a duty to design, construct, maintain and lay the active water pipes in a safe manner so that it did not leak and saturate the land with water.

Sunther said the families sought for between RM1.3mil and RM2.2mil in damages.
