Security guard’s conviction for participating in Hindraf rally upheld by High Court
KUALA LUMPUR: The High Court dismissed an appeal by a security guard against a Sessions Court decision finding him guilty of participating in an unlawful assembly organised by the Hindu Rights Action Force (Hindraf) in 2007.
In dismissing the appeal on Tuesday, judge Datuk Amelia Tee Hong Geak Abdullah upheld the conviction and sentence meted out by the lower court on M. Murugan, 49.
In her judgment, Amelia said the Sessions Court judge had not erred in convicting and sentencing Murugan of the charge on Sept 23, 2011.
Murugan was sentenced to 14 days jail and fined RM2,000 for the offence. He paid the fine.
Lawyer M. Visvanathan, who represented Murugan, said he would file for a stay of the jail sentence pending an appeal at the Appeal Court.
Deputy public prosecutor Dia Isda Yazmin Ismail prosecuted.
Murugan was the only one among 23 Hindraf supporters who pleaded not guilty when charged with the offence on Nov 28, 2007.
The others pleaded guilty and were fined.
They were charged with committing the offence at the Jalan Ampang traffic light intersection between 7am and 9am on July 25, 2007. - Bernama
