KOTA KINABALU: A 40-year-old restaurant manager has decided to marry a 13-year-old girl he had allegedly raped and she has agreed to accept his offer.
Deputy public prosecutor Ahmad Nazmeen Zulkifli told a Sessions Court here the girl withdrew her accusation against the accused in a police report on April 18.
The man had allegedly raped the student inside a parked car at a roadside in Inanam, near here, at 10am on Feb 18.
He claimed trial to the alleged offence on Feb 28. Counsel Loretto S. Padua, who represented the manager, told Sessions Court judge Ummu Kalthom Abd Samad that both the accused and the girl are in the process of getting married at the Syariah Court.
Ahmad Nazmeen said the prosecution has no objection to the case being withdrawn but the man needs to first settle the matter with the Syariah Court. Ummu Kalthom set May 20 for mention.
The accused was released on a bail of RM8,000 in two local sureties and to report weekly to the investigating officer in charge of this case.
In a separate case, a farmer was sentenced to 10 years' jail and 10 strokes of the rotan for attempting to rape his 10-year-old daughter in Kota Marudu on April 19.
