Tribunal orders maid agency to return RM4,000 to couple for breach of contract


A MAID agency in Shah Alam, Selangor, was ordered by the Johor Baru Consumer Claims Tribunal to refund an employer when a Malaysian maid they had hired failed to fulfil the contract.

Tribunal president Mohd Zahirullah Mohd Taib ordered the agency to return the RM4,000 fee to the claimant within two weeks.

The claimant Nabihah Farhana Ismail, 33, said that under the contract, the 40-year-old maid was supposed to work with the family for two years at their home in Skudai.

She said she deposited RM2,000 on two occasions to the maid agency’s bank account on Aug 20 and Oct 21 last year.

The maid was hired to take care of Nabihah’s two children aged 18 months and five years, and clean the house as both she and her 35-year-old husband had jobs.

“I paid RM4,000 in total to the agency and the maid came to our home on Oct 21, 2022,” Nabihah said when met outside the tribunal office in Menara Ansar after the hearing.

“My mother, who stayed with us for the first two weeks of the maid’s employment, found her work to be unsatisfactory,” she said.

Nabihah asked the agency to replace the maid after three months but this was not done and her subsequent calls and messages went unanswered.

The maid left on Jan 23 this year when the family terminated the contract.

Nabihah tried calling the agency many times to inform them that the maid was no longer working with the family but could not reach them.

She added that they then paid RM10,500 to a Kedah-based maid agency for an Indonesian maid in February as they were in desperate need of domestic help.
