Special fund to help JMB, MC collect overdue maintenance fees in Subang Jaya


Ng says the initiative not only ensures proper upkeep of flats but also enhances overall living conditions and property value.

A SUM of RM20,000 has been allocated for a newly introduced legal aid fund aimed at supporting Joint Management Bodies (JMB) and Management Corporation (MC) in Subang Jaya.

The fund, from the Subang Jaya assemblyman service centre, would be used in the management of low- and medium-low-cost flats, specifically addressing overdue maintenance fees.

Subang Jaya assemblyman Michelle Ng, who announced the initiative, said it was important to ensure that the first step towards collecting maintenance fee arrears did not involve legal enforcement.

Instead, JMBs and MCs are encouraged to offer repayment schemes first to property owners facing financial difficulties.

“Fifty to 70% of the residents in these flats are renters. While the majority of them pay their rent on time, it becomes problematic when property owners fail to uphold their obligation to pay maintenance fees,” she said.

When this happens, the JMB and MC are left with no choice but to pursue legal action as permitted by the Strata Management Act 2013, she noted.

“Residents must realise their obligation to pay maintenance fees,” said Ng.

“Neglecting this duty leads to poorly maintained flats and delays repairs of common property, which ultimately reduce the property value.

“Property owners have the right to elect suitable representatives to lead the JMB or MC, at the annual general meeting, if they are dissatisfied with the services.”

She highlighted the recurring problem where residents refused to pay because they believed services were inadequate, which worsened maintenance issues.

“It is a vicious cycle. If maintenance fees are not paid, service deteriorates further,” she said.

“We are providing this RM20,000 fund to help JMBs and MCs in collecting overdue maintenance fees.

“This is crucial because unpaid fees often lead to deteriorating conditions in these apartments,” Ng added.

The fund covers 50% of legal fees up to a maximum of RM3,000 for a year.

Each JMB and MC can select their legal representation and must fill up an application form to access the fund.

Legal aid has been requested by 24 flats, specifically within SS12 to 19, USJ 1 to 22, PJS7, 9 and 11.

“This initiative not only ensures proper upkeep of our flats but also enhances overall living conditions and property value in Subang Jaya,” Ng said.
