Rosmah lists 127 grounds in solar hybrid case appeal


PUTRAJAYA: Datin Seri Rosmah Mansor (pic) has listed 127 grounds of appeal on why her conviction and sentence in the RM1.25bil solar hybrid project case must be overturned.

The wife of former prime minister Datuk Seri Najib Razak listed the grounds in her petition of appeal which was filed at the Court of Appeal through Messrs Akberdin & Co on Thursday (Oct 14).

Among the reasons she listed was that trial judge Justice Mohamed Zaini Mazlan had erred in his conclusion and misdirected himself in his decision when he failed to give consideration to the appellant.

"The entirety of the trial judge's decision is 'berat sebelah' (one-sided) and was not based on the correct consideration in line with legal principles that have been decided in precedent cases.

"The entirety of the decision was based on an inaccurate conclusion and contradicts the testimonies at the trial," she said.

Rosmah further contended that Justice Mohamed Zaini was wrong to impose a heavy sentence on her when he failed to consider mitigating factors.

Her defence team also filed a separate petition of appeal alleging that Justice Mohamed Zaini was wrong in refusing to recuse himself from the trial on the grounds that a third party purportedly prepared the judgment which convicted her.

On Sept 1, Rosmah was convicted and sentenced to 10 years' jail on each of three corruption charges involving a RM1.25bil hybrid solar project for 369 rural schools in Sarawak.

Justice Mohamed Zaini ordered that the prison time run concurrently from the date of judgment, which means that the former prime minister's wife faces 10 years in jail.

He also fined her RM970mil, in default 10 years in jail, if she fails to pay.

Rosmah was allowed a stay of execution on the sentence pending an appeal to the Court of Appeal. She is currently out on bail.
