Speaker erred when calculating Harumaini's six-month absence, claims Pejuang


KLANG: Pejuang claims that Selangor Legislative Assembly Speaker Ng Suee Lim made an error when calculating the six-month period Harumaini Omar (pic) did not attend state assembly sittings, which was the basis of ejecting him from the Batang Kali seat.

In a statement on Friday (Feb 17), Pejuang information chief Rafique Rashid said Ng made a factual and legal error in expelling Harumaini for not attending state assembly sittings for six months without notice.

"This is because the calculation for the six months should have started from Nov 23, 2022, which is the date of the beginning of the Third Meeting of the Fifth Term of the Selangor Legislative Assembly 2022," said Rafique.

He said three legislative assembly meetings had been held in 2022 which were between March 14 to 18 and March 21 to 25; July 25 to 29 and Aug 1 to 5; as well as Nov 23, 25, 29, 30 to Dec 5 and 6.

Rafique added that Harumaini had attended the Second Meeting and was absent without notice only during the beginning of the Third Meeting on Nov 23.

"The expiration of the six-month period, in accordance with Article LXIX of the Selangor State Constitution, is on May 22, 2023," said Rafique.

According to Rafique, Harumaini had written to Ng to retract the announcement that the Batang Kali state seat had fallen vacant.

He said Harumaini gave Ng three days to respond, failing which, he (Harumaini) would reserve his right to initiate legal action.

"The letter has been copied to the Election Commission (EC) as well to the state legislative assembly secretary," he added.

Rafique said Harumaini should be reinstated as the Batang Kali assemblyman so that he could continue serving his constituents.

Ng had told a press conference on Thursday (Feb 16) that Harumaini was no longer the Batang Kali assembly for failing to attend the state assembly sitting for six months without notice.

He added that the EC had also been notified that the Batang Kali seat was now vacant.
