High Court dismisses Air Force personnel member's appeal in domestic violence case


SIBU: The High Court dismissed an appeal by an Air Force personnel member against his lengthy jail sentence after a conviction of voluntarily causing hurt to his wife four years ago.

Judge Wong Siong Tung affirmed the total jail time of 12 months imposed on Rizal Kamil, 41, by the Magistrate's Court on August 19, 2022.

However, Wong allowed Rizal’s application for a stay of his execution pending his appeal to the Court of Appeal within 14 days.

He released him on a bail of RM10,000 in one surety.

On August 19, 2022, Rizal was convicted by Magistrate Punitha Sivaraji after a full trial.

Rizal was charged under Section 323 of the Penal Code which is read together with Section 326A of the same Code for voluntarily causing hurt to his wife, Maslydiawati Masita, then 37.

He had at about 8.30pm on June 6, 2019, at a place in Jalan Ling Kai Cheng punched her on her head resulting in her sustaining multiple injuries.

Rizal through his counsel Harold Emparak had contended that the lower court had erred in passing the sentence as the attack was an accident and not voluntary.

Deputy Public Prosecutor Mark Kenneth Netto prosecuted the case.
