Teenager who committed incest gets three years in Henry Gurney School


BAHAU: A 15-year-old boy was ordered to be sent to the Henry Gurney School for three years by the Magistrate's Court here after he pleaded guilty to two counts of incest with his younger sister, who gave birth to a baby boy as a result.

Magistrate Norshazwani Ishak delivered the verdict on Tuesday (March 21) after hearing a probationary report on the accused read out by an officer from the Social Welfare Department.

She ordered the boy to be sent to the juvenile rehabilitation facility in Telok Mas, Melaka to serve his sentence.

The boy had pleaded guilty when he was charged on Feb 23.

He was charged with committing the offence against his 14-year-old sister between 11pm and midnight at a house in a Felda scheme in Jempol between June 21 and June 30 last year.

The second offence was allegedly committed between 11pm and midnight at the same house between Sept 1 and 10.

He was charged under Section 376B(1) of the Penal Code which carries a jail term of between 10 and 30 years and whipping upon conviction.

Under Section 376B, a person is said to have committed incest if he has sexual intercourse with another person whose relationship is such that they are not permitted under the law, religion, or custom to marry.

The victim delivered her baby on Feb 16 in the bathroom of their family home. She was assisted by her mother.

Ahmad Loqman Hakim Ahmad Khairie prosecuted while the boy was unrepresented.
