KUALA LUMPUR: Eight people have sued Rapid Rail Sdn Bhd and Prasarana Malaysia Bhd over the Kelana Jaya LRT crash almost two years ago, claiming that they have suffered physical injuries and other damage from the incident.
The group, aged between 26 and 47, named Rapid Rail and Prasarana as the first and second defendants respectively.
The plaintiffs are Tengku Amalie Tengku Alauddin Shah, Marvena Jitol, Riezariel Haeqal, Rozita Che Rus, Ng Siow Nee, Siti Nuraliah Hashim, Nurul Athirah Mohd K. Jabayee and Muhammad Firdaus Mohd Saleh.
They filed the lawsuit through Messrs Vin Partnership on March 9.
In their statement of claim, viewed by The Star, the plaintiffs said they were physically and mentally healthy before the accident that took place on May 24, 2021.
All the plaintiffs claimed that they took separate rides between 8.10pm and 9pm when a collision happened between the Kampung Baru station and the KLCC station.
They claimed that the accident happened as a result of the first and second defendants’ negligence in ensuring their safety.
They also claimed the defendants had failed to ensure that the trains were safe for use.
After the accident on May 24, 2021, the plaintiffs said that then Prasarana non-executive chairman Datuk Seri Tajuddin Abdul Rahman made jokes during a press conference by saying that the two trains “kissed each other”, and he was seen laughing at the event.
The plaintiffs said the defendants had failed to ensure that the LRT tracks were unobstructed by other LRTs, failed to execute a standard operating procedure that had caused the collision, failed to take necessary action in using technical expertise in LRT service, and failed to pay attention to the safety of the plaintiffs and other LRT users, among others.
The plaintiffs further claimed that the defendants had trivialised the actual situation and failed to consider the hardship and injury faced by the LRT users affected.
The group is seeking general, special, exemplary and aggravated damages, costs, and other reliefs deemed fit by the court.
The case has been fixed for case management via eReview before High Court senior assistant registrar Mohamad Hafizul Awang on April 11.
