KUALA LUMPUR: Former Education Malaysia Global Services deputy CEO has been acquitted by the Sessions Court here over a graft charge involving the supply for "Kurma For Ramadan Gift" four years ago.
Sessions Court judge Suzana Hussin made the order of a discharge and acquittal after finding the prosecution had failed to prove prima facie against Wafiy Abd Aziz, 38, at the end of the prosecution's case.
"Therefore, the court orders for the accused to be discharged and acquitted and the RM12,000 bail to be returned," she said.
Deputy Public Prosecutor Nor Diana Nor Azwa appeared for the prosecution while the accused was represented by lawyer Datuk Dr Baljit Singh Sidhu.
The prosecution trial began in Aug 2021 with 24 witnesses taking the stand.
In July 2020, Wafiy was accused of using his position as the EMGS deputy CEO to obtain gratification by approving an EMGS voucher dated June 3, 2019, and amounting to RM12,175 to Mileeya Enterprise for the supply of Kurma For Ramadhan Gift whereby the owner of the company was a relative of the accused.
The offence was allegedly committed at EMGS, Jalan Mayang Sari, here on June 3, 2019.
The charge under Section 23 (1) of the Malaysian Anti-Corruption Act 2009 carries a maximum 20 years imprisonment or a fine of no less than five times the amount of gratification or RM10,000, whichever is higher, upon conviction.
