PAS to wait for grounds of judgment before deciding on appealing Kemaman decision


PETALING JAYA: PAS is currently waiting for the grounds of judgment made by the election judge with regards to the Terengganu Election Court’s decision to nullify the party’s victory in Kemaman.

PAS secretary-general Datuk Seri Takiyuddin Hassan said that the party has 14 days before it has to make a decision on whether or not to appeal the verdict and therefore there was no reason for it to rush the process.

“At the moment, we are waiting for the recommendation or endorsement from the election judge under Section 36 of the Election Offences Act.

“In this case, the election judge has to give the grounds for judgments and this has to be gazetted. We want to see what are the grounds (for the judgement) first.

“Later on, we will decide whether or not to appeal because we have 14 days to appeal,” he said when contacted.

On Tuesday (Sept 26), the Terengganu Election Court annulled the victory of Kemaman MP Che Alias Hamid who represented PAS in the 15th General Election (GE15).

Judge Anselm Charles Fernandis said the petitioner, voter Wan Mohamad Hisham Wan Abdul Jalil succeeded in proving that corruption had taken place with the aim of influencing voters in GE15.

The court also ordered the respondent to pay RM30,000 to the petitioner.

On Feb 12, Wan Mohd Hisham's petition was struck out after the High Court accepted the preliminary objections raised by the respondents in the case.

However, the Federal Court, on May 2, overturned the lower court decision and ordered the case to be sent back to the High Court for a full hearing of the merits.
