PETALING JAYA: The senior cop who rammed his car into a Form Five student, resulting in the latter’s death, will be charged with murder today.
Attorney General Datuk Ahmad Terrirudin Salleh said after scrutinising the results of the investigation and based on the evidence in the investigation paper, the AG Chambers found sufficient evidence for a murder charge against the suspect.
“Therefore, the suspect will be tentatively charged at the Ipoh Magistrate’s Court under Section 302 of the Penal Code on Monday (today).
“The Magistrate’s Court will then determine a date to transfer the case to the Ipoh High Court for trial,” he said in a statement yesterday evening.
Earlier in Ipoh, Perak police chief Comm Datuk Seri Mohd Yusri Hassan Basri told reporters that the suspect tested negative for drugs.
He said 12 reports had been lodged on the matter since Friday, including some that were lodged by the public.
“We also urge witnesses with information and evidence to come forward to help with the investigation,” he added.
It was reported that the victim, Muhammad Zaharif Affendi Muhd Zamrie, 17, died on the spot following the accident at about 12.40pm.
The post-mortem found that the SMK Jati student died due to chest and abdominal injuries.
The 44-year-old police officer, who is said to be a deputy superintendent based in Kedah, was arrested and remanded until tomorrow to facilitate investigations.
The case is being investigated under Section 41(1) of the Road Transport Act for causing death by reckless or dangerous driving and Section 302 of the Penal Code for murder.
Lawyer Datuk Wan Azmir Wan Majid, who was hired by the student’s family, said he would collect evidence from videos and witnesses in the next few days.
“We will submit the evidence to the police, with hopes that it can help with their investigation,” he told a press conference at the family’s house in Taman Chepor Sentosa here yesterday.
“We are looking at negligence, malfeasance and vicarious liability by the government and the police force.
“But as of now, it is too soon to say who’s at fault or whether it was just an accident.
“We also must be fair and will let the police investigate first.”
The deceased’s father Muhd Zamrie Zainal Abidin said the family wanted justice and transparency.
The victim’s sister, Nur Zawani Muhd Zamrie, a 28-year-old nurse, who also attended the press conference, said she too wanted justice for her brother.
The deceased’s elder brother Zarul Fitri, 29, called on witnesses who were present during the incident or have dash cam recordings or CCTV footage of the incident to come forward.
“They can contact me personally to present the evidence,” he said.
