PETALING JAYA: Nur Sari Fardiana Mohd Amran plunged into depression following the death of her youngest child, whom she had unknowingly left in a car for about eight hours last month, the Sessions Court here heard.
The woman’s defence counsel, Datuk Hanif Hassan, had asked the court to consider a lower bail amount given the poor emotional state his client has been in since the tragic incident.
“Setting the bail at RM15,000 is too high considering the trauma faced by my client, who lost her own child, the victim in the case since the past month.
“She is also a businesswoman who had faced difficulties maintaining her online business due to the incident as she could not focus on her work.
“My client is a Malaysian with no flight risk and she has shown great cooperation throughout the proceeding,” he added.
Nur Sari Fardiana, 38, pleaded not guilty to the negligence charge which was read in front of judge Dr Syahliza Warnoh yesterday.
At the same court, Deputy Public Prosecutor Anis Hakimah Ibrahim suggested to the court to set bail at RM15,000 with one surety.
In addition to the bail, Anis also suggested to the court to set additional conditions to the accused by reporting at the nearest police station every month and not to bother any witnesses throughout the proceeding.
According to the charge sheet, investigations into the incident, which happened between 8am and 3.15pm in the compound of a house in Ara Damansara, found there was negligence involving a child aged two years old on Nov 8.
The charge was made under Section 31(1)(a) of the Children Act 2001, which carries a jail sentence of up to no more than 20 years or fine of up to RM50,000 or both, upon conviction.
The judge then set a bail of RM7,000 with one surety with the condition of reporting to the police station every month and prohibition from disturbing any witnesses throughout the proceeding.
She also set Jan 30 for mention of the case.
On Nov 9, it was reported that a two-year-old victim had died after being left by her mother for more than seven hours in a car at the Ara Damansara residential area.
It was reported that the mother of three dropped her two children off at a school first before sending the victim to a kindergarten.
However, when the woman arrived at the kindergarten, she then stopped to complete some business matters online and forgot to drop the victim off.
According to the Petaling Jaya OCPD Asst Comm Mohamad Fakhrudin Abd Hamid, the mother only realised her daughter was still in the car at about 3.35pm on the same day.
