IPOH: A lorry driver has claimed trial to four charges of physical sexual assault against his teenage daughter.
The 54-year-old pleaded not guilty after being read the charges under Section 14(a) of the Sexual Offences Against Children Act that was read together with Section 16 of the Act before Sessions Court Judge Ainul Shahrin Mohamad yesterday.
In the first charge, the accused is said to have instructed his then-16-year-old daughter to put cream on his private parts in a house at Taman Chemor Perdana towards the end of 2021 at about 9.30pm.
In the second charge, the accused is said to have hugged the victim from behind with a sexual intent in the same house at the end of 2021 at about 2am.
For the third charge, he is alleged to have used his daughter’s hand to rub his private parts at a house in Rancangan Perumahan Awam 2 on Oct 7, 2022, at about 6am.
The fourth charge says the accused allegedly rubbed part of the victim’s body in a house at Kampung Tersusun Tasek, Bercham, towards the end of 2022 at about 9.30pm.
The accused is liable to be jailed up to 20 years and whipped if convicted under Section 14(a) of the Act.
He will also be placed under police supervision for not more than three years under Section 295(1A) of the Criminal Procedure Code.
Section 16 of the Act also carries up to a five-year imprisonment and whipping of not fewer than two times.
While requesting for the accused to be denied bail, deputy public prosecutor Qurratu’aini Khalifah also asked for the accused to not disturb the victim and witnesses.
The accused, who was unrepresented, requested lower bail, saying that he still needed to pay the loan for his house, a car and a motorcycle.
Ainul Shahrin set RM7,000 with one surety for both cases and Feb 2 for mention.
