KUALA LUMPUR: Two policemen who were suspects in a rape-and-extort case involving an underaged girl have been hauled to the Ampang Sessions Court.
L/Kpl Muhammad Fazrul Razzi Yunus, 31, was charged with raping the girl inside a police patrol car while still on duty.
He was also charged with committing unnatural sex, carnal intercourse against the order of nature, and sexual assault against the 17-year-old victim near Persiaran Saujana Ampang at 10.30pm on Jan 9.
The accused was charged under Section 376(1), Section 377C, and Section 377CA of the Penal Code and Section 14(a) of the Sexual Offences Against Children Act 2017.
Muhammad Fazrul, who is a father of two, pleaded not guilty to the charges after they were read out before Sessions Court judge Norshila Kamaruddin here on Wednesday.
Deputy Public Prosecutor Nor Azizah Mohamad offered bail at RM20,000 for each offence.
“We also asked the accused not to disturb the witness and report himself at the nearest police station.
Lawyer G. Visvanathan Nair, who represented Muhammad Fazrul, asked for minimum bail on the grounds that his client was not a flight risk.
“My client is suffering from Myasthenia Gravis, a chronic autoimmune neuromuscular disorder causing muscle weakness and fatigue due to impaired communication between nerves and muscles.
“Bail also should not be used to punish a person as he is deemed innocent until proven guilty by this court.
The court fixed RM20,000 bail for all charges and fixed March 12 for mention.
At the Magistrate's Court, Muhammad Fazrul also faced another extortion charge with his partner, Kons Muhammad Adib Aikal Sharul Nizam.
They were accused of extorting RM500 from the victim and her boyfriend, threatening to spread their intimate video near Jalan Ampang Hillview on the same date and time.
The charge under Section 384 of the Penal Code carries a maximum of 10 years’ jail, a fine or whipping upon conviction.
Magistrate Amalina Basirah Md Top fixed RM4,000 bail for each of the accused.
