PUTRAJAYA: Rumah Bonda founder Siti Bainun Ahd Razali will be filing a new application for a stay of execution of her 12-year prison sentence for neglect and abuse of a teenage girl with Down Syndrome known as Bella three years ago.
Her lawyer Fatin Syaza Irdina Muhamad Eddin Syazri informed the Court of Appeal here that Siti Bainun would withdraw her appeal against an earlier High Court decision to dismiss her application to stay the execution.
Siti Bainun is expected to file a new application for a stay of execution before High Court Judge Justice Noorin Badaruddin.
“We have been instructed by our client, as the appellant, to withdraw the notice of appeal,” said Fatin Syaza Irdina.
Deputy public prosecutor Datin Asmah Musa did not object to the withdrawal of the appeal.
Justice Ahmad Zaidi Ibrahim, sitting with Justices Mohamed Zaini Mazlan and Azmi Ariffin, then struck out the appeal.
On May 2, Justice Noorin upheld the conviction and 12-year prison sentence against Siti Bainun, 32, after rejecting her appeal to set aside the conviction and sentence ruled by the Kuala Lumpur Sessions Court in May 2023.
Justice Noorin also dismissed Siti Bainun’s application for a stay of execution pending an appeal to the Court of Appeal.
On May 3, 2023, Siti Bainun was sentenced by the Sessions Court to 10 years in jail for the offence of negligence and 12 years for abuse.
Both sentences were ordered to run concurrently from the date of sentencing.
Sessions Court judge Izralizam Sanusi also ordered Siti Bainun to sign a five-year good behaviour bond with RM5,000 collateral in one surety as well as for the accused to serve six months of community service with an aggregate of 200 hours after completing her prison sentence.
Izralizam also ordered Siti Bainun to be sent to the Kajang Prison to serve an immediate 12-year prison sentence after dismissing her application to stay the sentence.
Siti Bainun was found guilty of neglecting and ill-treating the 13-year-old girl, causing the victim to suffer physical and emotional injuries in a condominium unit in Wangsa Maju between February and June 2021.
