PETALING JAYA: The Sessions Court here has ordered the defence in Zayn Rayyan Abdul Matiin’s case to report to the relevant authorities if there is social media content that invites subjudice comments that are contemptuous of the court.
Judge Dr Syahliza Warnoh decided this after lawyer Fahmi Abd Moin, representing Zayn Rayyan’s parents, said five TikTok accounts had made live videos considered subjudice.
“If there are further complaints about this matter, the defence can bring it up with the relevant authorities. The court wants to remind all parties again, especially the public, not to make comments that are in contempt of court,” the judge said yesterday, Bernama reported.
Earlier, Fahmi, assisted by lawyer Ilyani Khuszairy, told the court that five TikTok accounts had uploaded videos aimed at making comments that were subjudice and damaging to the case.
He said the accounts were CEO Zayn Rayyan, MyrasKitchen00, cikpika_pika_ii, BeMalaysian2.0 and MalaikatMaut382.
“We request that the five operators of these accounts be subject to a prohibition order. If they violate the order, our clients will make a police report,” said Fahmi.
Deputy public prosecutor Nurul Qistini Qamarul Abrar said the prosecution had yet to check the TikTok accounts as they were only notified about the matter.
“We request that the defence submit a new application accompanied by an affidavit to be shown to the court.
“At this stage, we feel that the request (by the defence) is premature but I leave it to the discretion of the court,” Nurul Qistini said.
Fahmi then requested a judicial notice as a warning to the TikTok account holders.
On June 13, Zaim Ikhwan Zahari and Ismanira Abdul Manaf, both 29, were jointly charged at the Sessions Court with neglecting their six-year-old autistic son, which may have caused him physical injury last year.
They both pleaded not guilty.
They allegedly committed the offence between noon on Dec 5 and about 9.55pm the following day in Damansara Damai here.
They were charged under Section 31 (1)(a) of the Child Act 2001, read together with Section 34 of the Penal Code, punishable under Section 31(1) of the Child Act.
Zayn Rayyan’s body was found on Dec 6 last year in a stream near his home at Idaman Damansara Damai Apartments here, a day after he was reported missing.The child is believed to have been murdered as the autopsy revealed injuries on his neck and body indicating a struggle.
Earlier, the defence team had asked the court to amend the victim’s name in the charge sheet presented by the DPP on June 13.
Fahmi informed the judge that the name Zayn Rayyan Abdul Matiin had been corrected to Zayn Rayyan bin Zaim Ikhwan.
He said they had received a birth certificate extract from the Selangor National Registration Department through Ismanira.
“I present a copy of the new birth certificate, which was received on July 4,” he said during the proceedings for case mention, Sinar Harian reported.Nurul Qistini confirmed she had received a copy of the birth certificate.
“Since this document was just handed over to the prosecution, we request that updates regarding the amendment be informed at the next proceeding,” said Nurul Qistini, who is handling the case alongside DPP Anis Hakimah Ibrahim.
Judge Syahliza then directed the prosecution to verify the matter with the National Registration Department, and that a decision regarding the amendment would be communicated during the case mention on Sept 18.
Lawyer Mahmud Abdul Jumaat also confirmed he no longer represented the mother.
