SELAYANG: The lawyer representing members of GISB Holdings Sdn Bhd (GISB), Datuk Rosli Kamaruddin says that the defence team will approach the Attorney-General’s Chambers (AGC) regarding the recent charges.
Rosli said on Wednesday (Oct 23) that a representation will be made concerning the charges laid under Section 130V (1) of the Penal Code against 22 members of GISB.
"Although the police have mentioned multiple Acts in their investigation, only one section has been used to press charges. We will make our case to the AGC, and the court will ultimately decide on the matter based on the evidence presented," he said.
When asked about the timing of the representation, he added that it would be submitted shortly, pending further instructions from their clients.
He spoke to the media after the appearance at the Selayang Sessions Court of GISB CEO Datuk Nasiruddin Mohd Ali, his spouse Datin Azura Md Yusof, and Adib At-Tamimi, son of Al-Arqam founder Ashaari Muhammad, all of whom were charged with being part of an organised crime group.
The accused individuals face potential imprisonment of five to twenty years if convicted under Section 130V (1) of the Penal Code.
Regarding a signed affidavit by Nasiruddin and three others, Rosli said that they would file an application questioning the validity of the charges under the Security Offences (Special Measures) Act, something that falls within the High Court's purview.
He added that several applications related to the case would be made next week.
"We will announce the details after submission, as we are currently awaiting our clients' directions," he said.
On the topic of some members' health concerns, Rosli said that a number of them are elderly with existing health issues and as such need medical attention following approximately two months in remand.
