IPOH: The prosecution will prove that a senior police officer had knocked his car into a motorcycle ridden by a 17-year-old student, resulting in the student's death last year, a High Court here heard.
The prosecution led by deputy public prosecutor Afzainizam Abdul Aziz said in his opening statement before justice Datuk Bhupindar Singh Gurcharan Singh Preet that the accused Deputy Supt Mohd Nazri Abdul Razak had knocked into the victim at a high speed without taking any evasive action.
Afzainizam said the speed limit allowed in the area where the incident took place is only 30km per hour.
“The act of the accused knocking his car had caused the victim to suffer injuries.
“We will also prove that the accused knew that his act was dangerous, and likely to cause death, and the accused acted in such a way with no reason,” he said on Tuesday (Nov 5).
DSP Mohd Nazri is accused of murdering Muhammad Zaharif Affendi Muhd Zamrie at the intersection of Jalan Taman Jati/Jalan Pekeliling Meru Indah near SMK Jati here on Dec 15 last year between 12.05pm and 12.40pm.
DSP Mohd Nazri was first charged at the Magistrate’s Court here on Dec 18 last year.
The prosecution team also consists of Nasrul Hadi Abdul Ghani, V. Suloshani, and Low Qin Hui.
The defence team is led by M. Athimulan, former Perak police chief Datuk Mior Faridalathrash Wahid, and Aiman Hakim Kamaruzzaman.
Afzainizam said the accused had gone to the school area in his car, and chased the victim who was on his motorcycle.
“The accused had followed, and chased the victim from the intersection of Jalan Taman Jati 1/Perkeliling Meru Indah heading towards the Al Fateh Muhammad Mosque and a housing area.
“Upon arriving at the end of the road of the residential area, the accused and the deceased had turned back towards the same path heading back to the intersection.
“But the accused continued to follow and chased the victim, and upon reaching the intersection, he (accused) had knocked the back of the motorcycle,” he added.
He said as a result of the collision, the deceased suffered injuries, and died at the scene.
Afzainizam said the medical examination and autopsy showed that the deceased suffered fatal injuries as a result of the collision.
Later, Justice Bhupindar Singh, the DPPs, lawyers and the accused had gone down to the court premises to see the car and the motorcycle which is part of the evidence for the case.
Three witnesses were called on the first day of the trial.
The three were Ipoh Police District headquarters complaint counter constable Muhammad Azif Daniel Abdul Ghaffar, its D5 branch exhibits storekeeper Kpl Md Zahir Abdullah, and police laboratory forensic investigation officer ASP Nur Fairuz Idris.
The trial continues tomorrow (Nov 6).
