IPOH: The prosecution team in the murder trial of a senior police officer will prove that he had intentionally rammed his car into a 17-year-old student riding a motorcycle, resulting in the teenager’s death last year, a High Court here heard.
The prosecution, led by deputy public prosecutor Afzainizam Abdul Aziz, said in his opening statement yesterday before Justice Datuk Bhupindar Singh Gurcharan Singh Preet that the accused, Deputy Supt Mohd Nazri Abdul Razak, had struck the victim at high speed without taking any evasive action.
Afzainizam said the speed limit in the area where the incident occurred is only 30km per hour.
“The act of the accused ramming his car into the motorcycle caused the victim to suffer injuries.
“We will also prove the accused knew that his act was dangerous and likely to cause death, and that the accused acted in such a way with no reason,” he said.
Mohd Nazri is accused of murdering Muhammad Zaharif Affendi Muhd Zamrie at the intersection of Jalan Taman Jati/ Jalan Pekeliling Meru Indah near SMK Jati here on Dec 15 last year between 12.05pm and 12.40pm.
Mohd Nazri was first charged at the Magistrate’s Court here on Dec 18 last year.
The prosecution team comprised Nasrul Hadi Abdul Ghani, V. Suloshani and Low Qin Hui.
The defence team was led by M. Athimulan, former Perak police chief Datuk Mior Faridalathrash Wahid and Aiman Hakim Kamaruzzaman.
Afzainizam said the accused had gone to the school area in his car and chased the victim, who was on his motorcycle.
“The accused had followed and chased the victim from the intersection of Jalan Taman Jati 1/Perkeliling Meru Indah, heading towards the Al Fateh Muhammad Mosque and a housing area.
“Upon reaching the end of the road in the residential area, the accused and deceased had turned back towards the same path, heading back to the intersection.
“But the accused continued to follow and chase the victim, and upon reaching the intersection, he (the accused) hit the back of the motorcycle,” he added.
He said the deceased suffered injuries and died at the scene.
Afzainizam said the medical examination and autopsy showed that the deceased suffered fatal injuries as a result of the collision.
Later, Justice Bhupindar Singh, the DPPs, lawyers and the accused went to the court premises to see the car and motorcycle that were part of the evidence.
Yesterday marked the first day of the trial and the calling of three witnesses, namely Ipoh Police District headquarters complain counter constable Muhammad Azif Daniel Abdul Ghaffar, its D5 branch exhibits storekeeper Kpl Md Zahir Abdullah and police laboratory forensic investigation officer ASP Nur Fairuz Idris.
The trial continues today.
