Dusuki's appointment as AG in accordance with rule of law, says Fahmi


PUTRAJAYA: Datuk Mohd Dusuki Mokhtar's recent appointment as Attorney General is in accordance with the rule of law, says Fahmi Fadzil.

The Communications Minister, who also serves as the spokesman for the unity government, said the appointment was in accordance with Article 145(1) of the Federal Constitution.

"His Majesty the Yang di-Pertuan Agong has consented to the appointment of Dusuki as the new AG, effective from Nov 12, replacing Tan Sri Ahmad Terrirudin Mohd Salleh, who has been appointed as a Federal Court Judge.

"Therefore, this appointment process is in line with the existing laws and as stipulated in the constitution.

"The appointment of Dusuki as the AG is based on the consideration that he has extensive experience in the prosecution field, having served for 31 years in the Attorney General's Chambers," he told a post-Cabinet meeting press conference here on Friday (Nov 15).

Fahmi also said that the Madani government remains committed to reforming the Attorney General's functions, with steps being taken to study the separation of the roles of Attorney General and public prosecutor, which began this year with empirical studies from Australia and Canada.

According to Fahmi, several rounds of roundtable discussions with legal experts, academics and civil society organisations, both domestically and internationally.

"By 2025, several engagement sessions with relevant stakeholders will be held, and an interim report from the study will be presented to the Cabinet in the near future," said Fahmi.

During the debate on Budget 2025 on Thursday (Now 14), Opposition MP Datuk Mas Ermieyati Samsudin (PN-Masjid Tanah) questioned whether Dusuki's appointment had any links to the role he played in the dropping of Deputy Prime Minister Datuk Seri Dr Ahmad Zahid Hamidi's corruption case.

She was referring to the 11 reasons provided by Dusuki that justified the prosecution's request for a discharge not amounting to an acquittal (DNAA) in Ahmad Zahid’s Yayasan Akal Budi case, in which Dusuki was the deputy public prosecutor.
